These Terms of Service ("Terms") govern access to and use of Akantik IAM (the "Service"), provided by Akantik IAM, headquartered at 313, Swara ParkLane, Atabhai Road, Bhavnagar, Gujarat, India – 364002 ("Akantik," "we," "us," or "our"). By registering for or using the Service, you agree to be bound by these Terms on behalf of yourself and, if applicable, the organization you represent ("Customer," "you").
1. The Service
Akantik IAM is an identity and access governance platform that helps organizations automate onboarding and offboarding, synchronize identities from HR systems, manage access across connected third-party applications, and run scheduled access reviews with an audit trail.
2. Account Registration and Activation
New accounts are created by submitting the registration form with your company and contact details. Your account is activated as soon as you submit the form, and a one-time password is sent to the admin email you provided so you can set your own password and sign in. To protect the security of the platform and the organizations that rely on it, we may suspend or close accounts that are created with false details or used in breach of these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. Connected Third-Party Applications
The Service allows you to connect third-party applications you use (such as Google Workspace, Microsoft 365, Slack, GitHub, Bitbucket, Jira, Asana, Workday, or SAP SuccessFactors) so that Akantik IAM can read identity data and provision, modify, or revoke access on your behalf, according to the permissions and policies you configure. You represent that you have the authority to connect these applications and to authorize Akantik IAM to act on your organization's behalf within them. Akantik IAM is not responsible for the availability, accuracy, or behavior of third-party applications themselves.
4. Customer Data
"Customer Data" means the identity, account, and access data that you or the Service import from your connected systems. As between you and Akantik, you retain all rights to Customer Data. We process Customer Data solely to provide, maintain, and improve the Service, and as described in our Privacy Policy.
5. Subscriptions and Fees
Paid subscription plans, billing cycles, and payment processing (via Razorpay) are described at checkout and in your account's subscription settings. Fees are non-refundable except where required by law or expressly stated otherwise. We may suspend or limit access to the Service for accounts with an expired or lapsed subscription.
6. Acceptable Use
You agree not to:
- Use the Service to violate any applicable law or the rights of any third party;
- Attempt to gain unauthorized access to the Service, other tenants' data, or connected third-party systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse engineer or attempt to extract the source code of the Service, except as permitted by law.
7. Confidentiality
Each party agrees to protect the other's confidential information with the same degree of care it uses for its own confidential information of similar nature, and not to disclose it to third parties except as necessary to provide or use the Service, or as required by law.
8. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Akantik disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, Akantik will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service.
10. Termination
Either party may terminate the agreement governing use of the Service as described in your subscription terms, or immediately if the other party materially breaches these Terms and fails to cure the breach within a reasonable period after notice. Upon termination, your right to access the Service ends, subject to any data export or retention terms described in our Privacy Policy.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify account administrators. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Bhavnagar, Gujarat, India.
